Dr.
Shirley Krauthamer, chair of the Los Angeles City College psychology
department, is accused by
gentleman-author-educator Mr. Thomas Shepherd, then 55 years old and
enrolled in a class taught by Krauthamer, of making a false and malicious
police complaint with the Los Angeles City College campus chief of police
against him on May 4, 1994, as retaliation merely because Mr. Shepherd had
several days before filed a formal complaint with the dean of students,
charging Dr. Krauthamer with mercilessly harassing him and encouraging the use
of inflammatory racist, sexist language in the classroom against him, in order
to intentionally inflame his emotions and make him hate himself.

What prompted Mr. Shepherd to file the
complaint was that Dr. Krauthamer had tried to get Mr. Shepherd to pretend a
fellow classmate, Jay, was his own father and to call Jay a “son-of-a-bitch.”
When Mr. Shepherd refused to comply with Krauthamer’s constant prodding that he
call Jay a “son-of-a-bitch,” a female classmate spoke up, expressing her
opinion that Krauthamer was being “too hard “ on Mr. Shepherd, to which
Krauthamer quickly replied, “I don’t think any of you students are being
hard enough on Shepherd.” Krauthamer thus encouraged the class members to
mercilessly humiliate Mr. Shepherd.
Dr.
Krauthamer had, from the onset, requested her students openly reveal
biographical information about their own lives, including about their sexual
experiences. Mr. Shepherd thus explained that on numerous occasions during his
adolescence, during military service and afterwards, he been a victim of sexual
assaults by other males, as well as a victim of inflammatory sexual innuendoes.
[As
a child, Mr. Shepherd underwent many years of treatment and surgery for a birth
defect – a partial cryptorchidism. Because his medical records were not kept
confidential, Mr. Shepherd became a victim of ongoing tormenting throughout his
young adult years – by both males and females.]
An
outspokenly racist anti-white, African-American adult male that claimed he had
been expelled from high school for raping another student and that he was
currently “married” to a white male, contemptuously referred to West Hollywood,
blond-haired, blue-eyed males as “faggots.” The same Anfro-American student
also said he admired Louis Farrakhan after Dr. Shirley Krauthamer (a
self-proclaimed Jew) expressed her contempt for him as a result of remarks he
had made that she considered anti-Semitic.
A
white adult female member of the class, Lillian, who appeared to be of
Anglo-Saxon ancestry herself stated that she hates it when she sees any
Anglo-Saxon male succeed in life.
Ironically,
Lillian also told Mr. Shepherd that he should not air his past experiences in
the classrooms, but should go to a psychiatrist.
It
was, of course, Dr. Krauthamer, that had urged all of her students to share
their experiences in the classroom – to talk about their experiences. It was,
of course, Krauthamer that kept prodding Mr. Shepherd to pretend Jay was his
father and call him a son-of-a-bitch.
The
very apparent fact is that Dr. Krauthamer was attempting to create a violent
confrontation between Jay and Mr. Shepherd, and when Mr. Shepherd refused to
play the game, Krauthamer then attempted to create a violent confrontation
between Mr. Shepherd and other classmates.
Certain
members of Dr. Krauthamer’s class, including Lillian, Jay [also an Anglo-Saxon
white male] and the Afro-American male that had repeatedly expressed contempt
for all white people in general, demanded that Shepherd apologize to them
merely for speaking about the fact that he had been sexually assaulted and
battered during his early years, claiming they had been offended because Mr.
Shepherd had merely spoken out in the classroom about assaults and batteries
committed against him by other males.
The
fact is that Mr. Shepherd himself had not said anything derogatory to or about
Lillian, Jay, the African American student or any other student. He was merely
talking about people from his past –
none of whom he mentioned by name.
It
was after that classroom session that Mr. Shepherd, highly stressed out as a
result of lies and the inflammatory racist and sexist remarks directed against
him throughout the semester, filed the complaint with Dean Bohanan after first
consulting with Dr. Ann Fogel, who encouraged the filing of the complaint.
Mr.
Shepherd was persecuted by Dr. Krauthamer and his classmates merely for telling
the truth about violent crimes, including sex crimes, committed against him by
both males and females during his youth.
Mr.
Shepherd also had mentioned to the class that as a result of the assaults
commited against him, he was several times hospitalized for psychiatric
observation. Thus, Krauthamer and the classmates, all of them studying to be
counselors themselves, made a concerted effort to inflame Mr. Shepherd’s
emotions sufficiently to produce a relapse – a mental breakdown.
Although
the Dean of Students, Gloria Bohanan, asked Dr. Krauthamer to sit down in a
private conference with Mr. Shepherd and two other faculty members, Dr. Ann
Fogel and Blythe Leiderman, and discuss the issues Mr. Shepherd presented,
according to Dr. Fogel, Dr. Krauthamer refused to comply with Dean
Bohanan’s request. Krauthamer instead took it upon herself to penalize Mr.
Shepherd for filing the complaint by excluding him from her class for the
remainder of the semester and by attempting to deny him credit for the class. Dr.
Krauthamer then told Mr. Shepherd’s classmates that he had voluntarily left the
class.
Although
Mr. Shepherd’s own conduct in the classroom was appropriate and above reproach,
Dr. Krauthamer reportedly told the LACC police chief that she was planning to
exclude Mr. Shepherd from her Group Dynamics psychology
class and that as a licensed clinical psychologist she believed Mr.
Shepherd should be kept under surveillance because he had told her that he had
a violent nature and that he should therefore be considered to be a
“potentially violent and dangerous individual.”
Mr. Shepherd never told Krauthamer that
he had a violent nature. Furthermore, Mr. Shepherd does not have a “violent
nature.” As a matter of fact, Mr. Shepherd, a former president of a protestant
interdenominational youth council and consultant to a law enforcement
assistance council, was described by other LACC faculty members and
professional associates as “a soft spoken, well-mannered gentleman.”
What
Dr. Shirley Krauthamer was doing was attempting to twist the truth 180 degrees,
based on Mr. Shepherd’s story about a group of violent males that had sexually
battered him, many, many years before and his very appropriate reaction to the
battering after previously having clearly warned his assailants to leave him
alone – to keep their hands off him. Mr. Shepherd’s reaction – a reaction of
self defense – was a very normal
reaction to the circumstances that existed at the time.
Mr.
Shepherd does not have a violent nature, nor has he ever had a violent nature.
He was – time and again – a mere victim of the incessant verbal humiliation and
violence meted out against him by others. He was also a victim of those who
make their living in the alcoholic beverage industry. And he was a victim of
many, many psychiatrists, clinical psychologists, social workers,
administrators and police or security guards working in the mental health
system, to include the West Los Angeles VA Medical Team.
Most importantly, Krauthamer
apparently failed to inform the LACC campus police chief – a Mr. Martinez –
that Mr. Shepherd had filed a formal (and proper) complaint against her several
days before, charging her with repeatedly violating standards of proper
classroom conduct and with encouraging other students to psychologically
terrorize Mr. Shepherd, and that the only reason she was attempting to
exclude him from her class was that he had filed a former complaint with the
dean of students, charging her with misconduct toward him. The only reason
she sought the police stakeout was to harass, embarrass and discredit Mr.
Shepherd for having filed the complaint.
As
a result of Dr. Krauthamer’s retaliatory action, a stakeout was authorized by
the LACC campus police chief. Mr. Shepherd was thus stalked, harassed and
publicly humiliated by the student peace officers, who apprehended Mr. Shepherd
from another classroom and falsely imprisoned Mr. Shepherd in a campus jail
cell for approximately 45 minutes, while they ran a warrants check on him,
which proved to be negative. NOTE: According to Dr. Ann Fogel, a Mr. Martinez,
who authorized the stakeout, replaced Shirley Smith as LACC campus police
chief.
The
three arresting peace officers, Ms. Domin, an Hispanic; Mr. Stringfellow, a
white Anglo-Saxon; and Mr. Clay, a Negro, were all students enrolled the
college criminal justice program. In
order to justify the arrest, Officer Clay falsely claimed – rather
screamed in an extremely hostile and violent manner – that Dr. Krauthamer told
Mr. Shepherd to never again return to the psychology building (Holmes Hall), at
the same time she told him she was merely excluding him from her class because
he had filed a complaint with the dean, not because he had violated any
law.
What
Krauthamer actually said, while Clay, Domin and Stringfellow were apparently
standing behind Mr. Shepherd was, “Shepherd, I am going to exclude you from my
class for the balance of the semester because you filed your complaint with the
dean. However, please come to my office [just a few doors away in Holmes
Hall] at the end of the hour to further discuss the issues.” Mr. Shepherd
made no attempt to reenter Dr. Krauthamer’s classroom. He instead went to Dean
Bohanan’s office to apprise Dean Bohanan of the situation. He then returned to
Holmes Hall to consult with Professor Leiderman at her classroom, across the
hall from Krauthamer’s Group Dynamics classroom.
In his complaint to the dean of students, which
was encouraged by two other psychology professors, Dr. Ann Fogel and Blythe
Leiderman, Mr. Shepherd charged Krauthamer with using vulgar language in the
classroom and with encouraging her students to use racist and vulgar
language in the classroom against him. He described in detail numerous
incidents in which Dr. Krauthamer, a self-professed Jew, cruelly demeaned him
and encouraged his classmates to harass him with racist and sexist remarks.
“I was one of only three white Anglo-American males
in the class, yet I was also the victim in every instance,” said the student, “
yet Krauthamer attempted to afterwards make me out to be the heavy. She was
very clearly playing racist and sexist politics, although her own prejudices
were decidedly anti-white-gentile-male.”
Mr.
Shepherd’s attorney, Adam Axelrad, later filed a damage claim against the Los
Angeles Community College District in behalf of the senior citizen
student-claimant for false arrest, false imprisonment, public humiliation and

In Mr. Shepherd’s complaint to the
dean, Krauthamer was accused of stepping outside the parameters of acceptable
classroom discussion by insisting that her students openly reveal personal
facts about their sex lives in the classroom. She wanted a show of hands
by her students if they were “homosexuals,” if they had ever “cheated” on their
spouses, if any of her students were HIV positive and if any of her male
students had ever “raped” anyone.
Professor
Shirley Krauthamer:”How many of you students are homosexuals? (about three
hands go up) Come on, get those hands up! . . . I know they are more of you? .
. . .I’m going to out all of you before this semester is over.”
Professor
Krauthamer: “How many of you students are HIV positive? (no hands go up . . .
long pause) “I can’t believe that not even one member of this class is HIV
positive. On the average, 5 percent of all my students are HIV positive. . . .
. however, statistics reveal that 25 percent of all people will lie.”
Several days
later, a Negro male student volunteered to the class the information that he
was HIV positive, no doubt as a result of Krauthamer’s previous attempt to
coerce the information out of her students, a clear-cut and unorthodox invasion
of student privacy.
When
Mr. Shepherd then, in all fairness, asked Krauthamer if she herself had any
homosexual tendencies, she replied to the class, “I once had a crush on a
[female] teacher.”
According to Mr. Shepherd, Krauthamer also
informed her students that she subscribed to Playboy magazine so that her two
sons would turn out to be “straight.” She then somewhat contradicted herself by
stating, “homosexuality is caused by a hormonal imbalance” and “a homosexual
can’t go straight.”
When one of the students (Jay) claimed his
sister had previously been a “Lesbian,” but that she had gone straight after joining
a church, then met and married a man, and that they had children and were very
happy together, Krauthamer dogmatically replied, “I seriously doubt if she’s
really straight, a homosexual can’t go straight.”
Dr. Shirley Krauthamer also advised
members of American minority groups to refuse to serve in the United States
Armed Forces.
NOTE:
Mr. Shepherd has since written Sex
and Sanity: The Myths and Realities of Human Sexuality in order
to further advance his opinions on the subject of human sexuality – that there
most probably exists a homoerotic dimension to every man – largely a hidden
dimension – as a result of social, political and economic pressures. Thus,
categorizing individuals as straight or gay is not only absurd,
but extremely dehumanizing and one of the most probable underlying causes of
sociopathic or neurotic behavior.
It is Mr. Shepherd’s opinion that most,
if not all people have an underlying capacity for bisexual behavior, but
that the Jewish, Christian and Islamic cultures mandate that individuals
suppress their homosexual feelings and experiences. Mr. Shepherd’s own
anthropological research indicates that the Ancient Greeks, Persians, and those
South Sea Islander cultures that have not been significantly influenced by
Jewish, Christian or Islamic doctrine, view all people to be “ambi-sexual.”
Thus, the terms homosexual and heterosexual do not have the same meaning as
they do for the God-fearing Jews, Christians and Muslims. Mr. Shepherd,
who defines himself as a classical existentialist, finds the custom of
labeling individuals as “straight” or “gay” or as “homosexuals” or as
“heterosexuals” to be not only absurd, but to be dehumanizing.
“ALL normal mature males (by nature) experience
homoerotic feelings, which they are pressured (for political, social and
economic reasons) into suppressing. MOST females,” says Shepherd,” admittedly feign
sexual interest in males in order to attract males, while their primary
interest in the male is security and economic. Experienced, mature males are
more aware of this fact than are naďve adolescent males. The sex drive is a primary
factor in male behavior. It is a secondary factor in female behavior. The
average males has approximately eight times the level of testosterone as the
average female. It is testosterone that propels the sex drive in both males and
females. Thus males, by nature, are more sexually responsive than are females,”
says Shepherd.
Mr. Shepherd states, “Krauthamer was engaging
in psychological rape of her students, by invading our privacy, by intimidating
us, by humiliating us and by encouraging the use of vulgar language in the
classroom. She was in effect engaging in a form of terrorism and in
anarchy. However, the police stakeout was the final straw. What she did to me
in particular was a far worse atrocity than what she did to the class as a
whole. If anyone ought to be kept under police surveillance,” says Mr.
Shepherd,” it’s Shirley Krauthamer. She comes across as an ill-bred Brooklyn schmuck,
to use a Jewish term, who apparently doesn’t understand what democracy is all
about.”
It is Mr. Shepherd’s opinion that Shirley
Krauthamer “is dangerously mentally disturbed and dangerously ill suited
for work as either a licensed clinical psychologist or as a teacher. She has never
offered an apology to me for her behavior.”
According to Mr. Shepherd, Dean of Men David
Agosto and Dean of Students Shirley Bohanan also violated his rights in the
manner in which they handled the matter. Mr. Shepherd claims both of them were
rude, threatening and abrasive towards him. Neither Agosto nor Bohanan was even
remotely schooled in the democratic legal process. Neither was technically
qualified to serve as a college dean, according to Mr. Shepherd.
“As my attorney later advised me,” says Mr.
Shepherd, “anyone who has been arrested has a legal right to immediately
receive a copy of the police report. Yet LACC administrators would not provide
me with a copy of the report in order to prove my case, to be able to defend
myself. Both Robledo and Agosto purposefully dragged their feet, thus avoiding
me an opportunity to defend myself. Finally, my pro bono attorney Adam Axelrad
obtained a copy of the police report for me several weeks later.
“I was the one who was the plaintiff, yet
Krauthamer, Agosto and the police wound up making me the defendant in an effort
to avoid all of the issues. Even Dr. Ann Fogel, the one who encouraged me from
the onset, later withdrew her support from me, as she no longer wished to stick
her neck out in behalf of justice. She herself later threatened to have me
removed from the program if I continued to pursue my quest for justice by
confronting those who had maligned me.
Both
Dr. Ann Fogel and Professor Blythe Leiderman used offensive language in the
classroom, according to Mr. Shepherd. Dr. Fogel referred to herself as being
“pissed off” about something during one of her lectures.
Professor Leiderman announced to the members of
her Abnormal Psychology class, of which Mr. Shepherd was a member, that
she was “a member of Club Fuck.” [Club Fuck was the actual name of a
Hollywood Club on Santa Monica Boulevard, near Vine Street, which was closed
down by the police as a result of repeated violations of the law, by admitting
teenagers to the club, by permitting contraband drugs on the premise, and by
tolerating live sex on the premise, according to another student who was
present in Leiderman’s class on the day she announced her membership in the
club.]
“I even
contacted attorney Johnny Cochran’s office for further legal assistance, in
hopes that he would enable me to take the matter to court after my pro bono
attorney filed the damage claim for me. However, I was told by Cochran’s
administrative assistant in so many words that Cochran was not interested in
representing a white male, which shows how racist and two-faced Johnny Cochran
himself was. I lost many jobs over the years for standing up for the rights of
blacks and Latinos. Not one of them EVER stood up for my rights. They’re all
phonies!
“What is outrageous,” claims Mr. Shepherd, “is
that Dr. Shirley Krauthamer was purposefully trying to incite racist, sexist
violence against me in the classroom and to demoralize me by
encouraging me to pretend another student was my own father and call him a
‘son-of-a-bitch.’ Yet it is indeed Dr. Kratuhamer (who claimed her own father
had deserted her mother and her) who is the violent and dangerous individual,
as were several of the students, both male and female, whom she encouraged to
harass me after I refused to call one of the students a son-of-a-bitch.
“Interestingly, one of my classmates who
harassed me the most after I refused to call classmate Jay a
‘son-of-a-bitch’ was Jay himself, who along with other classmates was
encouraged by Dr. Krauthamer to “be hard” on me. One of the other classmates
who harassed me the most during the entire semester was an outspokenly
aggressive Negro male from Brooklyn who revealed to the class that he had been
expelled from high school for raping a female student, that he was HIV positive
and that his domestic partner was ‘a white male.’ Nevertheless, he continually
made racist remarks, defaming white males in general, and referred to blue-eyed
white males in general as ‘faggots.’ I myself have blue eyes. In fact I was the
only male in the class with blue eyes on the day he made the remark.
“What is also outrageous is that the entire
LACC administration, including President Robledo, a native Salvadorian,
afterwards attempted to whitewash the incident. It was and still is a
cover-up, a travesty of justice. I shall once again emphasize that it was I
who was the victim Dr. Shirley Krauthamer’s violent nature, as well of as her
highly unethical conduct as a licensed clinical psychologist, college professor
and department chair! There is no excuse for the way I was treated by
Krauthamer, nor is there any excuse for the way I was treated by the Los
Angeles City College administrators and the campus police.
“Krauthamer, from the onset tried to intimidate me by
suggesting that merely by making a formal complaint that I was violating the
confidentiality of the other students. I myself am not violating anyone by
reporting the truth regarding the various ways in which I myself was harassed
and violated by Krauthamer and my classmates, and by reporting the various ways
in which my rights were abused by the outrageous police stakeout and the false
imprisonment. To the contrary, it is Shirley Krauthamer who has criminally
violated me.”
Mr. Shepherd, the injured 55-year-old student,
was recognized as a civil rights leader during his high school days, when he
served as citizenship chairman and president of a Missouri chapter of the
Inter-Racial United Christian Youth Council. He organized and conducted the
first inter-racial service at First Presbyterian Church, Joplin, Missouri in
February 1955. He was responsible for selecting Carol Young to be the first
Negro president of the West Missouri Diocesan Youth Convention in 1956. Miss
Young was elected president of the convention by a unanimous vote of the 97%
white members present.
He was also an active member of the First
Presbyterian Church, of St. Philip’s Episcopal Church and a student of Rabbi
Latz, a neighbor of his, at the United Hebrew Temple in Joplin during his
youth. Mr. Shepherd voluntarily participated in softball games and dances with
members of Missouri’s Negro community during high school. During his youth,
dated both Gentile and Jewish girls. He later became engaged to a Mexican law
student whom he met while attending the University of Mexico. Mr. Shepherd’s
older brother, John, was born in Mexico, where his parents owned and operated
El Cedro Silver Mining Company during the 1930s.
Following graduation from a Missouri high
school in 1956, Thomas Shepherd enrolled at the School of Philosophy and
Letters of the University of Mexico in Mexico City. Following his military
service with the Marine Corps Reserve and the U.S. Coast Guard, from which he
was honorably discharged, he received a B.A. degree from the University of
Okalahoma and pursued graduate studies in regional and city planning.
Mr. Shepherd voluntarily left the University of
Oklahoma graduate program with a B average, in good standing, as a result of
his having been repeatedly bullied by faculty members, to include a black
militant sociology professor, who condemned all of the white cvil rights
leaders at a special memorial service honored by the white student body to
honor Dr. King.
Dr. George Henderson, the black militant professsor,
stood at the podium and shouted at the white University of Oklahoma student civil
rights leaders, “You killed Martin Luther King.” Henderson also persuaded the
University of Oklahoma white president, John Holloman, a former undersecretary
of commerce, and a white Episcopal priest to shout at the white civil rights
students who came to honor the memory of Dr. King and to continue to support
the civil rights movement.
While a student at University of Oklahoma, Tom
Shepherd was also victimized by a white political science professor, Dr. John
Paul Duncan, who penalized him by issuing him a grade lower than he actually
earned for a class in History of Political Theory, merely because he had
exposed Dr. Duncan for having proposed and sanctioned a red-lining policy for
the express purpose of excluding all students wearing a beard from membership
in the Young Democrats Club, when there was no official University policy
discouraging male students from growing beards.
.Mr. Shepherd
afterwards served as a consultant and assistant planning director for a
Missouri regional planning commission and law enforcement assistance council,
where he was fired, five months after having been hired, merely for carrying out
his assigned duties and for complaining about ongoing vulgar sexual harassment
of him by the male executive director, by the female bookkeeper, by the female
secretary and by the planning director, Dr. Mary Magee. Shepherd has since served as an advisory
board member for two Los Angeles County mental health agencies, from which he
was wrongly terminated merely for addressing the issues of fraud and racial and
sexual harassment of him by black, Hispanic and Jewish personnel connected with
the agencies..
Shepherd is, on
his mother’s side, a third cousin of former congressman Barry Goldwater Jr.
On his father’s side Tom is a great great
grandson of University of Missouri
Professor Ignace Hainer, a lawyer and high-ranking member in the Hungarian
government, who joined hands with other pro-democractic revolutionaries in
declaring Hungary’s independence from the Austo-Hungarian empire in 1848, then
controlled by the Hapsberg Dynasty. After securing independence, the Hungarian premier, Batthyannyi was killed by invading
Austrians, while Ignace Hainer was imprisoned by the Austrians.
The United States of America then offered
Ignace Hainer asylum in the USA. He was soon after (in 1856) appointed a
professor of modern languages at University of Missouri, then fired by the Confederate
Governor of Missouri, Claiborne Fox Jackson, merely because he did not support
slavery, Missouri being a slave state. After voluntarily moving to Iowa, he was
appointed a member of the United States Grand Jury, then as local Postmaster, while
farming, serving as a volunteer school teacher and as treasurer of Decatur
County, Iowa.
Three of his
sons became practicing American lawyers, one (Bayard Taylor Hainer) appointed
an Associate Supreme Justice of Oklahoma Territory by President McKinley,
another, Eugene Hainer, elected to congresss from Nebraska, and another,Julius
Caesar Hainer, who graduated from Colgate School of Law in New York State, and
then was appointed a professor of medical jurisprudence at St. Louis College of
Physicians & Surgeons, which later became a part of Washington University.
Plaintiff and claimant Tom Shepherd insists
that Dr. Krauthamer should have been charged with criminal conduct by the
District Attorney of Los Angeles.
Although Krauthamer retired the following year,
she was chair of the Los Angeles City College psychology department at the time
of the 1994 incident.
Dr. Krauthamer, who is a native of Brooklyn,
New York, reportedly was awarded damages for an undisclosed amount against a
male LACC department chair and professor whom she claimed had sexually harassed
her prior to the spring 1994 semester.
Dr. Krauthamer, at about the same time period,
established a special scholarship, known as the Krauthamer-Squires Scholarship,
to honor herself and a long-time female companion, a certain Molly Squires, and
to be awarded only to a female student at Los Angeles City College.

Attempts to Cover Up Agency Fraud
Mr. Tom Shepherd Was Fired as a case manager and
benefits representative of a Los Angeles Mental Health Agency in October 1994
Merely for Complaining about Fraud and Incessant Sexist and Racist Harassment
of Him by His Female Supervisors and by a Male Office Secretary.
Five months later (on October 4, 1994) Mr.
Shepherd was officially terminated as a mental health rehabilitation counselor
and case manager for BACUP (also known as Benefits
Assistance Council, Los Angeles) a Los Angeles County Department of Mental
Health agency, of which he had also been appointed as an advisory board member.
He was terminated by Herbert K. Hatanaka, also a board member, as well as
executive director of Special Services for Groups and of the United Way, the
primary funding agencies for BACUP, an
agency created especially to assist homeless mentally ill individuals in Los
Angeles.
Mr. Shepherd was terminated by Hatanaka merely
for making a justified complaint to BACUP director Andrew Posner (a/k/a William
Posner) about continuous harassment of him by several employees, to include a
Negro male secretary, William Legere, who REPEATEDLY made cruel, inflammatory
racist and sexist remarks to Mr. Shepherd in an effort to undermine Mr.
Shepherd’s self-esteem. One of Legere’s remarks was, “How come, Tom, you are
older than O. J. Simpson, yet Simpson graduated from college before you.”
Legere, who handled the agencies employee tax records, asked Mr. Shepherd if
the M (his middle initial) stood for Mary.
Legere
also attempted humiliate Mr. Shepherd by telling Mr. Shepherd that his grammer
was incorrect in the way he worded a memo he gave to Legere to prepare for
mailing. The fact is that Mr. Shepherd’s grammer was indeed correct. It was
Legere that did not know the rules of English grammar – with regard to the use
of relative pronouns. Legere claimed the word that could not be used as
a relative pronoun, as in the following example: It is Legere that does
not know or understand the rules of English grammer. “Legere’s intention was to undermine my
self-esteem merely because I was an obviously intelligent white male – and also
because I was known to be a decent man. It is my opinon that Legere was merely
displacing his resentment of William Posner, his supervisor, onto me, as he was
secretly afraid of making offensive remarks to Posner, afraid of losing his
job.
Ironically, when Mr. Shepherd informed Andrew
(William) Posner of the ongoing sexist, racial and verbal abuse by Legere,
Posner excused Legere’s behavior, claiming Legere has a lisp.” Legere indeed
does have a very noticeable lisp, however, Mr. Shepherd had never, in any
manner, made light of Legere or any other employee.
Mr. Shepherd was also repeatedly harassed
with cruel, inflammatory sexual inuendos by Susan Paster, a BACUP co-ordinator.
Incidentally, Mr. Shepherd, then 55 years old,
was the oldest employee of BACUP at the time and had been REPEATEDLY described
as well-mannered and as an asset to the agency by Posner himself, prior to Mr.
Shepherd’s wrongful termination. Mr. Shepherd was repeatedly complimented by
Posner as being very well-liked and eager to help other employees, as well as
the agency’s clients.
Mr. Shepherd had also made a complaint about
his supervisor Pamela Nevarez, which harassment began after he refused to
assist Miss Nevarez in filing a fraudulent SSI claim for her boyfriend, a
Pakistani native. On the SSI document, Miss Nevarez encouraged the
claimant, her boyfriend, to falsely claim he was born in the U.S.A., when he
stated very clearly to her and to Mr. Shepherd that he was born in Pakistan.
When Mr. Shepherd first complained to Posner
about Nevarez’s misconduct, Posner replied to Mr. Shepherd, “I have had a lot
of complaints about her. Tell her to fuck off.” Although Mr. Shepherd did not
heed Posner’s very inappropriate advice, he was nevertheless terminated the
following Tuesday by Herb Hatanaka, after Miss Nevarez apparently went over
Posner’s head and misrepresented the facts to Hatanaka in an effort to gain his
sympathy.
According to Posner, Miss Nevarez became very upset
over the fact that he promoted Mr. Shepherd to the same level as Miss Nevarez,
as a benefits representative and case manager, after Miss Nevarez had
given Mr. Shepherd top ratings as an intern.
The fact is that Mr. Shepherd was better
professionally qualified than was Miss Nevarez, as he had earned a B.A. degree
in a behavioral science in 1969 from University of Oklahoma, where he majored
in political science and minored in sociology, and where he did graduate work
in regional and city planning. He was also concurrently taking special classes
in clinical psychology and counseling at Los Angeles City College in order to
better qualify himself for doing case management work.
Apparently Miss Nevarez did not even have a
bachelor’s degree, nor was she was licensed by the State of California to work
as a supervisor for case managers. She had attended several classroom seminar
sessions on the subject of social work conducted by Hatanaka at
USC and had a framed certificate over her desk stating so.
Herb Hatanaka justified firing Mr.
Shepherd by claiming that his supervisor, Miss Nevarez, was “only joking,” and
that Mr. Shepherd, who had a documented psychiatric history, as did Miss
Nevarez, Mr. Posner and all of the other employees of the agency, ‘couldn’t
take a joke and therefore couldn’t fit in.’
Even Dr. Areta Crowell, director of the
Los Angeles County Department of Mental Health, attempted to whitewash [thwart]
the investigation of Mr. Shepherd’s complaints by claiming that there was “no
evidence” of wrongdoing by Posner, Nevarez and Hatanaka.
Areta Crowell’s letter [dated March 2, 1995] to
Mr. Shepherd, written in response to a complaint Mr. Shepherd made to Los
Angeles County Supervisor Mike Antonovich, is posted below.
By the way, contrary to Dr. Crowell’s statement
in her letter, Patient’s Rights Advocate [Lynn Goldinger] never
contacted Mr. Shepherd to discuss the matter. In fact, Goldinger, who was
appointed to the BACUP advisory board by Posner, was involved with
Posner and Hatanaka in sanctioning the aggressive processing of disability
claims, based on a “quota” system that existed at BACUP, according to Mr.
Shepherd. “There was a great deal of pressure put on Pamela Nevarez and Susan
Paster, both of whom were Posner’s aides, to aggressively process as many
disability claims as possible in order for the agency to qualify for funding
through the United Way and through State, County and Federal subsidies, which
funding, of course, paid their salaries! BACUP was more of a business than a
human services agency. Hatanaka, of course, was the fiduciary agent, the one
who ultimately certified that the agency was qualified for funding, as well as
for performing case management services to those clients who had been certified
as mentally ill,” according to Mr. Shepherd.
Prior
to ever contacting Supervisor Antonovich, Mr. Shepherd wrote a lengthy, 4-page
letter to Dr. Crowell, dated October 14, 1962, immediately following his
termination at BACUP. Mr. Shepherd’s letter went into explicit detail regarding
the corruption that existed at BACUP and the manner in which BACUP officials
(Posner, Hatanaka, and Nevarez) attempted to harass and discredit anyone
who rocked the boat. Mr. Shepherd also contacted Social Security claims
examiners and state disability claims examiners, as well as Governor Peter
Wilson, regarding the corruption. Mr. Shepherd had also contacted an agent of
the FBI in October, several days prior to his unlawful termination by
Hatanaka.
When Mr. Shepherd repeatedly attempted to
contact Dr. Crowell at her office by telephone, Dr. Crowell’s assistant [a
female] claimed Crowell was “unavailable.” When Mr. Shepherd asked Crowell’s
assistant to have her contact him to discuss the matter, she never
contacted him, which is why Mr. Shepherd contacted Supervisor Antonovich
When Mr. Shepherd, highly stressed out,
later made repeated phone calls to BACUP, reminding his supervisors of what
they said and did to him, he was arrested on a charge of “making annoying phone
calls,” although the Los Angeles City Attorney dismissed the charges. In his
complaint to the police, Posner (according to the police report) stated that he
believed Mr. Shepherd to be “on medication for paranoid schizophrenia” and that
he was “terrorizing” Posner by leaving messages for him on the BACUP office
answering machine [while the office was closed] during Rosh Hashanah.
According to the police report, Posner claimed
in his statement to the police that Mr. Shepherd “resigned.” Mr. Shepherd did not
resign. He was wrongfully fired by Hatanaka merely for complaining about
harassment of him by Nevarez and Legere and of criminal behavior by Nevarez [in
her attempt to falsify an SSI application for disability benefits for her
boyfriend].
Under California law it is unlawful for
an employer to terminate an employee for making such a complaint.
Mr. Shepherd’s phone calls reminded Posner that
Posner himself, Pamela Nevarez, Susan Paster (all coordinators) and William
Legere (a Negro male secretary) regularly used offensive, racist, sexist,
language in the office, much of it directed against Mr. Shepherd, in an effort
to demoralize him as a white, Anglo-Saxon Gentile male. Mr. Shepherd also
reminded Posner (a self-professed Jew) that his office policies were
Anti-Gentile in that he gave all his Jewish employees the day off on Jewish
holidays, while making Gentiles (Mr. Shepherd and Miss Nevarez) work on those
days. He also required Mr. Shepherd and Miss Nevarez to work on the Jewish
Sabbath (Saturday). On Saturdays there was neither air conditioning nor air
circulation in the office, and there were no windows that could be opened for
healthy ventilation.
Interestingly, Miss Pamela Nevarez herself
had been outspoken in expressing to Mr. Shepherd her annoyance with Posner’s
Anti-Gentile office policies, prior to Mr. Shepherd’s termination.
The actions of both Miss Nevarez and Mr.
Hatanaka were decidedly criminal in nature, yet Mr. Shepherd was the one who
was terminated from his position as a mental health rehabilitation counselor
for BACUP, a Los Angeles County mental health agency, merely for speaking out
about fraud and abuse. Ironically, it was also Mr. Shepherd who wound up being
[falsely] charged with a crime, merely for complaining about the fraud and
improper behavior of Miss Nevarez, Mr. Hatanaka [who reportedly receives an
annual salary in excess of $100,000] and others connected with the agency.
Prior to being retained as a benefits
assistance counselor and case manager, Mr. Shepherd served an internship at
BACUP in conjunction with a human services counseling program he was enrolled
in at Los Angeles City College.
During his internship at BACUP, Mr. Shepherd’s
supervisor, Miss Nevarez, gave him outstanding ratings in eight
categories and above average ratings in two categories on an
evaluation she completed for Dr. Ann Fogel of Los Angeles City College. Miss
Nevarez furthermore characterized Mr. Shepherd as “well mannered, well groomed,
soft spoken, relates well with staff and clients, is attentive and learns
quickly.”
Miss Nevarez’s evaluation of Mr. Shepherd was
signed by her and dated May 5, 1994, the day after Mr. Shepherd was victimized
by a false arrest and false imprisonment at Los Angeles City College for making
a justified complaint of harassment and abuse regarding his teacher, Professor
Shirley Krauthamer. Mr. Shepherd received an A from Dr. Fogel on
his transcript for his overall performance in the LACC intern program.

Herbert Hatanaka has a SWD (a doctorate) in
social work from the School of Social work at University of Southern
California, where he is also an adjunct faculty member.

Note that the check designates Tom Shepherd’s
position as that of ‘trainee’ although he was working as many hours as Posner
and Nevarez and Paster as a ‘case manager’ and benefits representative. Prior
to his terminantion, he was repeatedly complimented by Bacup’s executive
director Andrew Posner on his performance – to include his demeanor – his
finesse – in dealing with difficult problems—in interviewing and processing
claims for clients.
Mr. Shepherd later learned through his own
investigation, that BACUP’s qualifications for doing case management had been
misrepresented by Hatanaka at the time the agency was formed. According to
California State Law, in order for an agency to be certified for handling
mental health disability case management, there must be a licensed social
worker or a licensed clinical psychologist present in the agency office at all
times to act as a supervisor. There was never any such person present in the
BACUP office, then located at 1336 Wilshire Blvd.
BACUP
director Andrew Posner (who
listed his name as William Posner on his City of Los Angeles police
complaint) was not licensed as either as social worker or as a clinical
psychologist. He claims to have attended the undergraduate division of
University of California at Berkley. He also has made public statements at
Department of Mental Health political meetings, describing himself as suffering
from “manic depressive” psychosis. Although he was repeatedly heard using
expletives such as “Godammit” in the office during working hours, according to
Mary Ann Matos, another employee, he censured her for uttering the expletive
“shit” in the office.
Herbert Hatanaka’s office was at 1313 W. 8th
St., the business office for Special Service for Groups. About the only time
Herbert Hatanaka himself ever set foot in the BACUP office, according to Mr.
Shepherd, was when he attended the monthly advisory board meetings, which Mr.
Shepherd also attended. However, Hatanaka made a special visit to the BACUP
office on October 4, 1994, with the primary purpose of terminating Mr. Shepherd
without giving Mr. Shepherd a proper hearing.
Prior to Mr. Shepherd’s termination by
Hatanaka, Mr. Shepherd had reported his observations to a Los Angeles agent of
the FBI, urging the FBI to investigate the irregularities at BACUP, which
irregularities he described to the agent in detail.
